Promotional Period:    The period between 9:00am AEST 4th August 2023 to 11.59pm AEDT 30th November 2023.

Definitions:

Sales Appraisal: An estimate of a property’s price in the current market conducted by a LJ Hooker Franchisee.

LJ Hooker Franchisee: a qualified real estate agent authorised to operate within the LJ Hooker franchise network, as may be located at the website: https://www.ljhooker.com.au/find-an-agent.

Relevant Territory means each of the following Australian states and/or territories:

  • Queensland and Northern Territory
  • New South Wales
  • Victoria
  • Tasmania
  • Australian Capital Territory
  • South Australia
  • Western Australia

Eligible entrants:         

Entry is only open to Australian residents who are 18 years or over and own at least one (1) residential property in Australia and who are not:

  • directors, officers, management members or employees (and the immediate family members of directors, officers, management members or employees) of the Promoter or any of its franchisees or associated companies; or
  • otherwise involved in the conduct or management of the Promotion.
How to enter

Entry Requirements:

To enter the Promotion, Eligible Entrants must, during the Promotional Period:

  1. own at least one (1) residential property in Australia; AND
  2. book a Sales Appraisal for a residential property they own with an LJ Hooker Franchisee by one of the following methods:
  • coming into an LJ Hooker Franchisee's office to request a Sales Appraisal, OR
  • request a Sales Appraisal online (via ljhooker.com.au), OR
  • request a Sales Appraisal by telephone by calling an LJ Hooker Franchisee; AND
  1. have a free Sales Appraisal of the residential property they own conducted by an LJ Hooker Franchisee within the Promotion Period; AND
  2. provide their full name, contact number, email address and postcode of their primary residence in Australia to the LJ Hooker Franchisee which conducts the Sales Appraisal,

(Qualifying Entry).

Each Eligible Entrant with a Qualifying Entry will be entered in the Prize Draw for the Relevant Territory in which the residential property for which they had a Sales Appraisal is situated.

Entry Conditions:

Qualifying Entries will be limited to one entry for each residential property owned by an Eligible Entrant. If more than one Sales Appraisal is conducted for the same residential property, only the first Sales Appraisal will be deemed to be a Qualifying Entry.

Prize:

There will be one (1) main prize of a $5,000 VISA gift card (Main Prize) and seven (7) other prizes each of $1,000 VISA gift cards (Secondary Prizes) with one Secondary Prize drawn for each Relevant Territory.

The Main Prize and each Secondary Prize will be referred to as a 'Prize' and the winner of each Prize will be referred to as a 'Prize Winner'.

Prize Draw:

A random electronic draw of Qualifying Entries will take place at Lvl 26, 161 Castlereagh Street, Sydney NSW 2000 at 1:00pm AEDT on Friday 8th December 2023, and:

  • one (1) Qualifying Entry will be drawn from all Qualifying Entries in Australia for the Main Prize; and
  • one (1) Qualifying Entry will be drawn from the Qualifying Entries in each Relevant Territory for each of the seven (7) Secondary Prizes.

The draw will be conducted by the Promoter and will be entirely random.

Unclaimed Prize Draw:

If any Prize is not claimed by the winner of the Prize Draw in accordance with the Terms and Conditions, an unclaimed prize draw will be held on 22nd December 2023 at the same time and place as the original Prize Draw. All Qualifying Entries (except the Qualifying Entries drawn in the Prize Draw) will be entered in the unclaimed prize draw and the same process will be followed as for the Prize Draw with one (1) Qualifying Entry randomly drawn to select a winner for each Prize that has not been claimed.

Winner Notification and Claiming the Prize:

The Promoter will, within 2 business days of the Prize Draw, notify the winners of the Prize Draw in writing by email via the email address provided as part of the Qualifying Entry. The winners of the Prize Draw must claim the Prize within 14 days of being notified, by confirming their acceptance of the Prize to the Promoter in writing to marketing@ljhooker.com.

If any winner of the Prize Draw fails to claim their Prize in accordance with the above, the winner will be taken to have forfeited their Prize and the Promoter will then offer that Prize to the winner of the applicable Unclaimed Prize Draw.

The Promoter will notify each winner of the applicable Unclaimed Prize Draw in writing by email, via the email address provided as part of the Qualifying Entry. The winner of an Unclaimed Prize Draw must claim the Prize within 4 days of being notified by confirming acceptance of the Prize to the Promoter in writing to marketing@ljhooker.com.

Publication of Winners:

The name (surname and initial of fist name) and postcode and/or State/Territory of residence of each Prize Winner will be published on www.ljhooker.com.au within 2 business days of the Prize Draw and/or Unclaimed Prize Draw. 

General Terms and Conditions
  1. By entering the Promotion, entrants agree to be bound by the Terms and Conditions of the Promotion, which consist of these General Terms and Conditions and the terms set out in the Promotion Details.
  2. No entry fee is charged by the Promoter to enter the Promotion. Where entry is allowed online, there is no additional cost to enter the Promotion other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.
  3. The Promoter is not responsible for any communications network or any late, lost, incorrectly submitted, delayed, ineligible, incomplete, corrupted or misdirected entry whether due to error, transmission interruption or otherwise.
  4. It is a condition of entry into the Promotion that entrants provide the Promoter with their correct first and last name, and valid contact number and email address. Where an entrant's contact details change at any time after entering the Promotion and before the date of the Prize Draw, the entrant must notify the LJ Hooker Franchisee which conducted the Sales Appraisal of their correct contact details immediately. Any entries will be void if the correct contact details are missing or invalid. The Promoter is not responsible for any incomplete or incorrectly submitted details provided by an entrant.
  5. The Promoter reserves the right, at any time, in its sole discretion to verify the validity of entries and eligibility of entrants (including an entrant's identity, age, place of residence and any other details forming part of an entrant's eligibility or the Entry Requirements) and to require an entrant to provide proof or documentation to confirm an entrant's eligibility to enter the Promotion and claim the Prize.
  6. The Promoter reserves the right to disqualify any entrant whom the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper conduct calculated to jeopardise fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an entrant are reserved.
  7. The results of the Prize Draw (and any Unclaimed Prize Draw) are final and no correspondence will be entered into.
  8. It is a condition of accepting Prize that the Prize Winner agrees to: (a) the publication of their name, postcode and/or State/Territory of residence in accordance with these Terms and Conditions; (b) participate in all publicity reasonably requested by the Promoter in connection with the Promotion (and the Prize); (c) consent to the use of their name, image and likeness in any media for an unlimited period without remuneration in connection with the Promotion (and the Prize), and for promotional purposes related to the Promoter and/or its franchisees; and (d) at the Promoter's reasonable request, do all things necessary (including signing all documentation) necessary to give effect to this clause and/or to enable the Promoter to provide any part of the Prize.
  9. The Prize must be taken as stated and no compensation will be payable if the Prize Winner is unable to use the Prize as stated. The Prize is not transferable or redeemable for cash or other goods or services. The Prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting the Prize that the Prize Winner accepts the conditions of use of the Prize.
  10. The Promoter accepts no responsibility for any variation in the value of the Prize, or any costs or expenses associated with use of the Prize.
  11. If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize (or part thereof) to the equal value and/or specification, subject to any directions from a regulatory authority.
  12. A failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  13. If for any reason the Promotion is not capable of running as planned (including, but not limited to infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter may take any action that it considers necessary including cancelling, terminating, modifying or suspending the Promotion without any further obligations to any entrants or the Prize Winner. Subject to regulatory approval where required.

 

  1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any similar consumer protection laws in the states and territories of Australia (Non-Excludable Guarantees).
  2. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, its franchisees and related entities (including its respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (c) any variation in the Prize or Prize value to that stated in these terms; (d) any tax liability incurred by a beneficiary of the Prize; (e) any use or taking of the Prize; or (g) the Promotion.
  3. Complaints regarding the Promotion may be submitted by email to compliance@ljhooker.com. If there is a dispute concerning the complaint, the decision of the Promoter will be final and no further correspondence will be entered into.
  4. All entries become the property of the Promoter. Entrants consent to the Promoter using personal information provided in connection with the Promotion for the purposes of facilitating the conduct of the Promotion, awarding any Prizes (including to third parties involved in the Promotion and any applicable statutory authorities) and providing marketing communications. Without limiting the foregoing, entrants’ personal information provided in connection with the Promotion will be handled in accordance with Australian Privacy Principles and the Promoter’s Privacy Policy, which is available at: https://www.ljhooker.com.au/legals/privacy-policy

Membership and points are subject to the Qantas Frequent Flyer program terms and conditions. In order to earn points, your residential property must be listed and sold or leased exclusively with LJ Hooker in Australia. This offer cannot be used in conjunction with any other rewards program in which LJ Hooker participates. Your Qantas Frequent Flyer membership number and the number of points you will receive after settlement must be clearly agreed on at the time of the exclusive listing and clearly stated in your LJ Hooker exclusive agency agreement for sale of your property. If no reference is included, points will not be allocated. Qantas Points will be credited to the person/s on the exclusive agency agreement.

*** This is a once only, per property point's allocation, with points being credited upon successful settlement of the property. The offer does not apply if the property is also listed with another agent other than LJ Hooker. You must be a Qantas Frequent Flyer member at the time of signing your listing agreement to be eligible. To redeem points the name on the agency agreement must match the name on the Qantas Frequent Flyer membership card. If the name does not match then the points will not be transferred. The number of Qantas Points the vendor is entitled to must also be clearly stated on the agency agreement at the time of listing. If the number of Qantas Points are not agreed at the time of listing, Qantas Points will not be awarded.
